Authorization to work without a work permit – International Mobility Program (IMP)

The International Mobility Program (IMP) allows Canadian employers to hire foreign workers without having to first obtain a labor market impact assessment (LMIA).

There are two types of work permits that can be issued under the IMP:

1. Open work permits: These are issued to foreign nationals who meet certain criteria, including having a valid job offer from a Canadian employer.

2. Employer-specific work permits: These are issued to foreign nationals who have a valid job offer from a specific Canadian employer.


After-sales service as part of a warranty or sales agreement

It’s been clarified that the warranty or sales agreement can be for goods or services.

The foreign national is working in Canada to perform after-sales service on behalf of a person with whom they have a contract, and

The contract clearly states that the after-sales service will be performed in Canada

The foreign national is not working in Canada for more than 90 days

Consequently, the work being done by the foreign national meets all of the following requirements:

It’s an integral and essential part of, but not the main purpose of, the warranty or sales agreement;

A foreign national who meets the conditions above may work in Canada without a work permit. However, they must still comply with all other requirements under the Immigration and Refugee Protection Act (IRPA) and Immigration Regulations, such as those related to admissibility.


To be exempt from the work permit requirements, the foreign national must:

- Have a valid passport;

- Have a letter of introduction from Immigration, Refugees and Citizenship Canada (IRCC) confirming that they’re allowed to enter Canada; and

- Meet the requirements of the Immigration and Refugee Protection Regulations.

The foreign national may also need a temporary resident visa, depending on their country of citizenship.

If the foreign national doesn’t meet all the conditions listed above, they must apply for a work permit.


General criteria

To be eligible for an open work permit, the foreign national must:

- Have a valid job offer;

- Be a highly skilled worker;

- Be a graduate of a Canadian post-secondary institution;

- Be a participant in the International Experience Canada program;

- Be the spouse or common-law partner of a highly skilled worker or a graduate of a Canadian post-secondary institution;

- Be a refugee, protected person, or family member;

- Have a claim for refugee protection that’s been accepted by the Immigration and Refugee Board of Canada (IRB) but hasn’t yet received refugee status;

- Be a Convention refugee recognized by another country and you’ve been legally admitted to Canada for resettlement;

- Have made a claim for refugee protection that’s been accepted by the IRB, but you haven’t yet received refugee status;

- Have been granted humanitarian and compassionate grounds;

- Work in certain “low-wage” occupations, for a limited period;

- Work in the live-in caregiver program, for a limited period.


To be eligible for an employer-specific work permit, the foreign national must:

- Have a valid job offer from a specific Canadian employer; and

- Meet the conditions of the offer of employment.

Foreign nationals who are eligible for an open work permit may also be eligible for a bridging open work permit. A bridging open work permit allows foreign nationals to keep working while they wait for the results of their permanent residence application.


Employees of foreign companies contracting Canadian companies

To work in Canada, foreign nationals employed by foreign companies that have contracted Canadian companies must apply for a work permit. The requirements are as follows:

The foreign company has a contract with a Canadian company to provide goods or services;

The foreign national is working in Canada on behalf of the foreign company, under the terms of the contract between the foreign company and the Canadian company;

The work being done by the foreign national is an integral and essential part of, but not the main purpose of, the contract between the foreign company and the Canadian company;

Apply for Trade Show Funding in advance of Trade Shows

Small businesses can apply for government funding to attend trade shows both in Canada and internationally.

The Trade Show Access Program (TSAP) is a Canadian government program that provides financial assistance to small- and medium-sized enterprises (SMEs) to attend eligible tradeshows and events in Canada and abroad. The goal of the program is to help SMEs increase their exports and grow their businesses.


To be eligible for TSAP funding, your business must:

- Be a small- or medium-sized enterprise (SME)

- Have less than 500 employees

- Have been in business for at least one year

- Be registered and operating in Canada

- Be planning to attend an eligible trade show or event

- Have a booth at the eligible trade show or event

- Be exhibiting Canadian-made products or services

- Use TSAP funding to offset costs related to attending the trade show or event, such as travel, accommodation, booth space, and shipping

If your business is planning to attend a trade show or event, you should apply for TSAP funding in advance. The application process can take several weeks, so it’s important to start the process as early as possible.


Employees of short-term temporary residents

If you’re a short-term employee of a foreign company that has been contracted to provide services in Canada, you may need a work permit. You will need a work permit if:

The work being done by the foreign national is an integral and essential part of, but not the main purpose of, the contract; and

The work being done by the foreign national is in addition to, and not part of, the work being done by employees of the Canadian company.

In these cases, the foreign company will need to apply for a work permit on behalf of its employees. The work permit application must be submitted before the employees come to Canada.

As a short-term employee of a foreign company, you may also need a temporary resident visa (TRV) to enter Canada. If you’re from a country that requires a TRV, you must apply for one before you come to Canada.
